1. Agreement to Terms
These Terms and Conditions of Sale (“Terms”) constitute a legally binding agreement between you (“Customer,” “you,” “your”) and Buy Bourbon Whiskey (“Company,” “we,” “us,” “our”) governing your purchase of products from our website, [buybourbonwhiskey.com], or via other authorized channels. By placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Definitions

  • “Consumer” means an individual acting for personal, non-commercial purposes.

  • “Business Customer” means an individual or entity acting for purposes related to their trade, business, craft, or profession.

  • “Dispatch Confirmation” means our email confirming your order has been shipped.

  • “Products” means the alcoholic beverages and related goods we offer for sale.

4. Age Restriction and Legal Compliance
4.1. The purchase and delivery of alcoholic beverages are strictly regulated. You affirm that you are at least 21 years of age.
4.2. You may only purchase Products if you are of legal age to do so in both your jurisdiction and the delivery destination jurisdiction. It is your responsibility to know and comply with all applicable laws.
4.3. You warrant that you are purchasing Products for personal consumption or as a gift for another person of legal drinking age. You may not purchase Products for resale unless explicitly authorized by us in writing as a Business Customer.
4.4. We reserve the right to refuse any order and to require age verification at delivery. Failure to provide valid proof of age will result in canceled delivery, and you will be responsible for associated costs.

5. Product Information and Pricing
5.1. We strive for accuracy in product descriptions, images, and pricing. However, we do not guarantee that all information is error-free. Product packaging may vary. We reserve the right to correct any errors and to update product information at any time without prior notice.
5.2. Prices are listed in US Dollars (USD) and are subject to change. Online prices may differ from in-store prices due to promotions. The price charged is the price in effect at the time your order is accepted.
5.3. All prices exclude applicable sales tax, excise tax, and delivery charges, which will be calculated and displayed at checkout.

6. Orders and Contract Formation
6.1. Placing an item in your cart does not reserve the product or constitute an order. An order is an offer by you to purchase Products.
6.2. Our acceptance of your order occurs when we send the Dispatch Confirmation. Only upon sending this confirmation does a binding contract come into existence between us.
6.3. We reserve the right to refuse or cancel any order before dispatch for any reason, including but not limited to product availability, pricing errors, or suspicion of fraudulent intent. If your order is canceled after payment, a full refund will be issued.

7. Pre-Orders
7.1. Products marked “Pre-Order” are not yet in stock. By placing a Pre-Order, you authorize us to charge your payment method immediately.
7.2. Estimated delivery dates are provided in good faith but are not guaranteed. We are not liable for delays caused by suppliers or events beyond our reasonable control.
7.3. You may cancel a Pre-Order at any time before the Dispatch Confirmation is sent for a full refund.

8. Payment
We accept major credit/debit cards and other payment methods as displayed at checkout. You represent and warrant that you are authorized to use the chosen payment method. All payments must be cleared before Products are dispatched.

9. Delivery, Title, and Risk
9.1. We deliver to addresses within the United States and to select international destinations (excluding Africa and South America). You are responsible for ensuring the delivery address is correct and that someone of legal age is present to receive the shipment.
9.2. Delivery timelines are estimates. We are not liable for delays caused by carriers or force majeure events.
9.3. Title and Risk of Loss: Title to the Products passes to you upon our delivery to the carrier. The risk of loss or damage passes to you upon our tender of the Products to the carrier for domestic shipments. For international shipments, risk passes upon delivery to the international delivery agent.
9.4. International customers are solely responsible for all import duties, taxes, and customs clearance procedures. We cannot advise on these charges.

10. Returns, Refunds, and Cancellation (Consumer Customers)
10.1. Due to the nature of our Products (sealed alcoholic beverages), all sales are final unless the product is:
* Faulty (e.g., spoiled, contaminated),
* Incorrectly shipped (you received the wrong item), or
* Damaged in transit (you must note damage on the carrier’s slip at delivery).
10.2. Claims for faulty, incorrect, or damaged products must be reported within 7 days of delivery. Please contact us immediately at [email protected] with your order number and details/photos of the issue.
10.3. We do not accept returns for “change of mind.” If a return is authorized under Section 10.1, we will provide a prepaid return label or arrange for pickup. Upon receipt and verification of the issue, we will issue a full refund (including shipping costs) or a replacement, at our discretion.

11. Warranties and Limitation of Liability
11.1. FOR CONSUMERS: We are liable for foreseeable loss and damage caused by our breach of contract or negligence. We do not exclude liability for death, personal injury, fraud, or for any matter where liability cannot be limited by law. WE ARE NOT LIABLE FOR BUSINESS LOSSES (loss of profit, business, or opportunity) as our Products are sold for personal, non-commercial use.
11.2. FOR BUSINESS CUSTOMERS: All Products are provided “AS IS.” To the fullest extent permitted by law, we disclaim all warranties, express or implied. Our total liability to a Business Customer shall not exceed the total purchase price of the Products in the order giving rise to the claim.

12. Privacy

13. Governing Law and Dispute Resolution
These Terms and any dispute arising from your purchase shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Orange County, Florida.

14. General Provisions
14.1. We may transfer our rights under this agreement. You may not transfer your rights without our written consent.
14.2. If any provision of these Terms is held invalid, the remaining provisions will remain in full force.
14.3. Our failure to enforce any right is not a waiver of our right to enforce it later.
14.4. These Terms, together with our Privacy Policy and any order confirmation, constitute the entire agreement between us regarding your purchase.
